Terms of Use
Version 2026-10-18
What every member agrees to
- I understand this app is independent and unofficial. It is not affiliated with, endorsed by, sponsored by, or connected to Mattamy Homes or any other home builder, and no builder staff run it.
- I understand the app only helps me record and track my own warranty issues. It does not submit anything to Mattamy for me. I must send every warranty request to the builder myself, through the builder's own channels.
- I understand nothing in this app is legal advice, and using it does not create an attorney-client relationship with anyone. Deadlines, warranty periods, and law summaries may be incomplete, outdated, or wrong for my home.
- I am responsible for doing my own research, checking my own warranty manual, purchase agreement and deadlines, and getting my own legal advice. I will not rely on this app to protect any right or meet any deadline.
- I use the app at my own risk, as is, and I agree to the Terms of Use, including the limits on liability and the release of the app's organizers and volunteers.
1. Who we are, and who we are not
Home Warranty Tracker is run by the volunteer organizers of the Newfield Homeowners Alliance as a free tool for homeowners. It is independent and unofficial.
It is not affiliated with, endorsed by, sponsored by, or connected in any way to Mattamy Homes, Mattamy Home Funding, any Mattamy entity, or any other home builder, lender, or warranty company. The name "Mattamy" appears only to describe whose warranty a homeowner is tracking. All trademarks belong to their owners.
2. What the app does
The app helps you write down your own warranty issues, keep your photos, ticket numbers and emails in one place, and see dates you may want to watch.
The app does not contact the builder, submit warranty requests, sign in to any builder portal, or act for you in any way. Anything you send to the builder, you send yourself. A request is only made when the builder receives it through its own process.
3. Not legal advice
Nothing in the app is legal, financial, engineering, or professional advice. The organizers are not your lawyers, and using the app creates no attorney-client or other professional relationship.
Summaries of warranty terms, Florida statutes, and deadlines are general information that may be incomplete, out of date, or wrong for your home, contract, or situation. Your warranty manual, purchase agreement, and the law control, not this app. Talk to a licensed Florida attorney before relying on any date or making any legal decision.
4. Your responsibilities
You are responsible for doing your own research, for checking every date and requirement yourself, for sending your own warranty requests and notices on time, and for keeping your own copies of your records.
Do not rely on the app to meet any deadline, preserve any claim, or prove anything. Reminders may be late, missing, or wrong, and the service may be unavailable or lose data.
Only enter information you have the right to share. Do not upload your full purchase agreement, financial account numbers, or anyone else's private information.
5. No warranties
The app is provided as is and as available, with no warranties of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose, availability, or freedom from errors or data loss, to the fullest extent the law allows.
6. Limitation of liability and release
To the fullest extent the law allows, the volunteer organizers of the Newfield Homeowners Alliance, and their volunteers, admins, and members, are not liable for any loss or damage of any kind arising from or related to the app, including a missed deadline, a denied or late warranty claim, lost data, or reliance on any information in the app, whether the claim is based on contract, negligence, or anything else.
You release them from all such claims. Where the law does not allow a full release, their total liability is limited to zero dollars or, if that is not allowed, the smallest amount the law permits. The app is free; you pay nothing for it.
7. Indemnity
You agree to cover any claim, loss, or cost brought against the organizers because of what you upload, how you use the app, or your dealings with any builder.
8. Community statistics
Members' issue data may be combined into anonymous community statistics (for example, typical response times by category). Groups with fewer than five homes are hidden and figures are shown as ranges, to reduce the chance of identifying any one home; this lowers that risk but cannot remove it entirely. Statistics are descriptive only and are not findings about any builder.
Your name and street address go on a group notice to a builder or HOA only if you choose "Add my name" for that specific concern. A notice that has been sent may be kept by the organizers and by the recipient even after you delete your account.
9. Access, changes, and ending
Access is for homeowners in participating communities. Accounts open automatically when setup is finished; admins may check public property records and suspend or remove access at any time. Builder staff may not use the app.
These terms may change. When they do, you will be asked to agree again before continuing. You can export your data or delete your account at any time from Settings. Deleting your account removes your home, issues, photos and notes; the admin log and any group notices already sent may keep a record.
10. Governing law
These terms are governed by Florida law. If any part is found unenforceable, the rest still applies.
